CLERMONT, Florida – It did not take long for Robery Dylan Daley, 26, to wind up in police custody Friday for fraudulent use of a credit card and petit theft once police saw the same tattoo he has above his right eyebrow on a Walmart surveillance camera video.
The case against Daley traces back nearly two weeks to when a Clermont woman’s Toyota Seinna was burglarized and the woman’s purse stolen. It contained a blue Chase Sapphire credit card, Florida Driver license and other miscellaneous items, according to a police report. Law enforcement learned that “[v]ideo in the area revealed a silhouette of a subject walking in the area of the victim[‘]s house” on the relevant date and time.
Shortly after the burglary the victim received a Facebook Message that her credit card had been located in a Walmart parking lot and had been turned over to the lost and found department. She checked her credit card account and “she found the blue Chase Sapphire card was used at 0324 hours, 0326 hours, and 0327 hours at RaceTrac loated at 3201 US Highway 27 in Clermont… [and] that the same Blue Sapphire [c]ard was used at the Walmart located at 1450 Johns Lake Road in Clermont”, according to a police affidavit. (A $1.68 Walmart transaction was completed, but a $500 transaction minutes later was declined – and a fraud alert issued.)
As the arresting officer reports, “I responded to Walmart and met with the Loss Prevention Manager who showed me video of the transactions. The video provided clear pictures of the suspect using the blue Sapphire credit card… .” The officer – together with a second officer – “positively identified” Daley “through previous encounters, DAVID, and in house data bases.” The linchpin to the case, however, appears to be that Daley “has very distinctive tattoos on his arms, legs, neck, and one easily identifiable tattoo just above the right eyebrow. This is clearly depicted in comparison photographs and the video retrieved at Walmart”, the affidavit states.
Daley was booked into the Lake County Jail on a $3,000 bond.
