EUSTIS, Florida – A Umatilla man is facing charges of aggravated assault with a deadly weapon and criminal mischief after witnesses told police he beat on a door so hard he broke a window, punched his brother’s truck and then tried to run his brother over.
According to the arrest affidavit, on Tuesday, Wayne NeSmith, 30, was upset his girlfriend received a text message from a man who was at his brother, John Locke’s house on Wall Street in Eustis. (Witnesses later told police the text message was sent to her accidentally.)
Locke told police NeSmith arrived at his home and beat on the front door so hard, a window in the door shattered, the report states. Locke told NeSmith he was going to call the cops, which in turn made his brother NeSmith angrier. NeSmith then punched the right fender of Locke’s truck, causing about $400 in damage, according to the affidavit. NeSmith next got in his truck and began to back out of the driveway; as he did, Locke exited the home with a baseball bat and began yelling at NeSmith, telling his bother he would be going to jail. That is when NeSmith allegedly put his truck into drive and attempted to run his brother over. Four other witnesses backed up Locke’s story, according to police.
Reportedly armed – with “shots fired” – police located NeSmith and arrested him at gunpoint. He was released Wednesday on $7,000 bond.
